STUDIO POLICIES 

1. Cancelation/Rescheduling

The Photographer shall reserve the date and time agreed upon and will not make other reservations for said date or time.  In the event that the client cancels the contract for any reason, all monies paid shall be retained by the Photographer in order to offset its loss of business.  

If a session must be canceled by the photographer due to weather, illness of photographer or client or his/her family members, or other emergencies, the session will be postponed to a later mutually agreed upon date.  

Client may reschedule the session if the photographer is given a minimum of 24 hrs notice prior to the session start time. The new session must occur within 60 days of the original session date.  If the Client fails to reschedule a session, all monies paid shall be retained by the Photographer.

The photographer is not responsible if Client and/or key individuals fail to appear in the portrait session. Photographer will wait for the Client for a period of 60 minutes, beginning at the session start time.  If Client and/or key individuals fail to appear to the session, the session fee is non-refundable and a new session fee and session date will need to be booked.

2. Cooperation

Client acknowledges that Photographer cannot and will not guarantee any particular results, including Client’s desired result.  If Client and/or key individuals do not cooperate during the session for certain setups or poses, Photographer will move on to other poses and/or setups.

3. Electronic Devices 

Cameras, phone cameras and video are not permitted during the session unless approved by the photographer.  

4. Editing Policy

All images will be edited as per the photographer’s artistic style demonstrated in the photographer’s portfolio. 

Special requests for retouching must be communicated at the ordering appointment.   

No further editing will be done after the product(s) has been ordered or delivered.  

5. Ordering Appointment & Payment 

The client is responsible for paying the session fee to book a session.  

Client will be presented with the proofs during a viewing appointment within 2-3 weeks of the session.  During this time, Client will be asked to place an order.  Client may choose a collection of his/her choice or choose products from the A la Carte menu.  

Full payment must be made at the ordering appointment.  Payment can be made by cash, cheque, or with major credit cards through Square or Paypal.  Payment plans are available.  All services and products are subject to sales tax. 

No part of any order, including previews, will be delivered until the balance is paid in full.  If Client cancels an order after it is placed, a 50% cancelation fee will apply to orders that have not yet been sent to the lab for production.  Once an order has been sent for production, it is deemed non-refundable.  

6. Safety

Client and his/her family members are responsible for their own safety in the studio or at the outdoor location.  

7. Travel 

A minimum travel fee of $25 will apply for outdoor shoots further than 25 km from the photographer’s studio.  

8. Archiving and Re-Orders 

Photographer will archive digital files of all ordered images for Client for up to one year from the session date.  Unordered images will be purged 90 days following the viewing appointment.  Photographer does not guarantee backup photographs, prints, or data after this time.  

9. Intellectual Property Rights and Release

Due to The Copyright Act of Canada, no RAW format or unedited images will be provided for download.  

The Copyright of ALL images is held by Kenna Kay Photography.  Therefore, clients can PRINT images, but cannot edit or alter the images (this also includes placing filters on the image). 

Images may not be used for financial gain without written consent from the photographer, including but not limited to contests and resale. 

10. Equipment failure 

If Kenna Kay Photography cannot fulfill this contract due to fire or other causality,  an event beyond the control of the photographer, or due to the photographer’s illness or emergency, then the photographer shall return any monies paid to the client but shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials such as print products are damaged or lost without fault on the photographer.
